- Have the legal capacity to enter into binding contracts
- Represent a legitimate business entity (for paid services)
- Provide accurate and complete information
4. User Accounts
Some features require creating an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your account information is accurate and up-to-date
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

You may not copy, reproduce, distribute, modify, or create derivative works without our written permission.
6.2 User Content
By submitting content to us (e.g., contact forms, feedback), you grant Stellarwind a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for the purpose of providing our services.
7. Pricing and Payment
7.1 Services
We offer the following services:
- Intelligent Pipeline: AI-powered lead qualification and pipeline management
- Marketing Engine: Multi-channel marketing automation
- Agent Productivity: Team productivity and operations automation
- Custom Apps: Bespoke AI-powered applications
Pricing is determined based on implementation complexity, consultant count, lead volume, and other business factors outlined in the ROI Calculator.
7.2 Payment Terms
- Prices are quoted in USD or EUR (as specified)
- Payment is due within 30 days of invoice date (unless otherwise agreed)
- Late payments may incur interest charges of 1.5% per month
- We reserve the right to suspend services for non-payment
7.3 Refund Policy
Due to the custom nature of our AI automation systems, all sales are final. Refunds are evaluated on a case-by-case basis and may be issued at our sole discretion.
8. Service Guarantees
8.1 ROI Guarantee (3x Return)
We guarantee a minimum 3x return on investment within 12 months for paid implementations. If you do not achieve 3x ROI, we will work with you at no additional cost until the guarantee is met.
Note: ROI guarantee requires full implementation of recommended system, compliance with best practices, and provision of accurate business metrics. Excludes external factors beyond our control (market conditions, client business changes, etc.).
8.2 Uptime and Availability
We strive for 99.9% uptime for our systems. However, we do not guarantee uninterrupted service due to maintenance, updates, or circumstances beyond our control.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STELLARWIND SHALL NOT BE LIABLE FOR:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Errors, inaccuracies, or omissions in content
- Unauthorized access or use of our servers
- Interruption or cessation of service
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $1,000 USD (whichever is greater).
10. Indemnification
You agree to indemnify and hold harmless Stellarwind, its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use of our services
- Your violation of third-party rights
- Your submission of inaccurate or fraudulent information
11. Termination
We may suspend or terminate your access to our services at any time, with or without cause, with or without notice. Upon termination:
- Your right to use our services immediately ceases
- We may delete your account and data (subject to legal obligations)
- Provisions regarding intellectual property, liability, and disputes survive
12. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:
- Services will be uninterrupted, secure, or error-free
- Results will be accurate or reliable
- Defects will be corrected
13. Governing Law and Disputes
